Wage and Hour Compliance

Wage and hour laws are extremely complex and are (unintentionally) violated more than any other employment law.

Although recently updated in August 2004 in an attempt to clarify overtime eligibility, the Fair Labor Standards Act is still a potential minefield for any employer.  Often states requirements differ from federal laws, which create an additional level of compliance.

COPE can conduct an analysis of job duties and organizational pay practices to make sure that your organization meets its obligations and remains in compliance with both state and federal regulations.  We focus on the following areas: 

  • Reviewing positions to ensure proper classification as exempt or nonexempt from overtime requirements
  • Reviewing pay practices including deductions of pay for salaried exempt employees and appropriate inclusion of all pay for nonexempt employees in overtime calculations such as on-call pay, travel time, bonuses and shift differentials

COPE will assist you with transitioning employees into the appropriate exempt or nonexempt status and make recommendations or assist with modifying pay policies or practices if necessary.
